Mobotix applies for patent cancellation in wake of suit

NEW YORK—Embroiled in a patent lawsuit with e-Watch, Mobotix Corp. has successfully lobbied for suspension of the suit pending an examination of the validity of the patents involved, Mobotix announced Oct. 29.

The company has also applied to the U.S. Patent and Trademark Office seeking cancellation of all existing patents in the suit, being heard in federal court in San Antonio, according to the news release.

Mobotix says documents and presentations on the Mobotix M1 camera from a 2000 CeBIT trade show prove the disputed technology was widely publicized before it was patented, making it state-of-the-art technology. The company also says the suit will be invalid if it turns out the patents are on material that was not patentable.

"We will have our defenses up when it comes to patent lawsuits also in the future and we will always check all of our legal options," said Magnus Ekerot, Mobotix Corp. CEO, explaining the company's corporate strategy in a prepared statement.
